The summer and winter transfer windows were established as part of a compromise agreement with the European Commission about how the entire transfer system operated and how it could best preserve contractual stability for both the player and the club while allowing movement at predetermined times during the year.
The alternative was to make football more like to the majority of other businesses, where contracts were not legally binding or entitled to fair pay, with players free to leave at any time and notice periods being served.
The European football authorities believed that this would gravely weaken the footballing economy and take away clubs’ incentives to invest in player development.
